Three-judge panel upholds Scheibe's (I) election to school board

A three-judge panel upheld L.M. "Mike" Scheibe II’s election to the Shenandoah County School Board, ruling that his 2004 Pennsylvania felony conviction does not bar him from public office under Virginia law.

The order, entered Feb. 5, denies the election challenge brought by Scheibe's opponent, Brent N.A. Wilson, who argued that Scheibe's felony record rendered him constitutionally ineligible to serve.

Kyle Ford, a law clerk with Harding Counsel who represents Wilson, said Feb. 5 that they will appeal the decision to the Supreme Court of Virginia.

Scheibe defeated Wilson in the November election for the District 1 seat, receiving 1,566 votes (58.15%) to Wilson's 1,089 votes (40.44%). Wilson filed his challenge in Shenandoah County Circuit Court on Dec. 4.
